A person is considered to be driving while intoxicated if his or her blood alcohol level is .08 or above. An individual must submit to a breathalyzer test even if he or she does not believe that he or she is drunk or above the .08 limit (if probable cause exists). Failing to do so will result in a loss of license of 7 months or more.
