  • Has your spouse filed for divorce in Union County, New Jersey or in another county? We can help you immediately!

artusa-hoboken-minSanto Artusa, Esq is a Union County divorce lawyer that represents individuals in the Union County Superior Court and throughout New Jersey. Some of the clients we have represented had family law and divorce issues including but not limited to: dividing marital property (N.J.S.A. 2A:34-23.1-equitable distribution statute), child custody disputes (N.J.S.A 9:2-4f.), child support, alimony (N.J.S.2A:34-23), parenting time and other issues in contention.

Some of our clients have seen their properties whether in Westfield, Cranford or in Union, skyrocket then return to more “normal” levels but in many cases a considerable amount of equity has been accumulated and is a great source of contention in the equitable distribution aspect of the divorce case. It is important to determine who invested what during the marriage and before the marriage. Other assets that come up in Union County divorce cases involve vacation and investment properties, the 401k, annual bonuses, pension plans, restricted stock awards, stock options and other deferred compensation plans as many people that live in Westfield and the surrounding areas work on Wall Street and/or other industries in Manhattan.

In many cases, one spouse seeks alimony and it most be noted that alimony is never automatic. A case for alimony must be prepared correctly to automatically obtain an alimony award whether it is an open duration period,   a short term period or meant for reimbursement purposes, the lifestyle enjoyed in the marriage must be depicted and proven to the family court judge if the case goes to trial. CAUSES OF ACTION-GROUNDS FOR DIVORCE USED IN UNION COUNTY-NEW JERSEY DIVORCES

New Jersey has several different fault and no fault causes of action to use in a case. The most commonly used from my experience are: irreconcilable differences, 18 month separation, adultery, and extreme cruelty. The first two are considered no fault causes of action while the others are considered fault. Fault may be used for embarrassing your spouse but many times it has no effect on the award of alimony or the division of property, so it may be best to use the no-fault allegations.
